Terms of Service
Effective Date: May 11, 2026Welcome to Movie Night Polls! These Terms of Service (“Terms”) are a legal agreement between you and Movie Night Polls (“we,” “our,” or “us”) and govern your access to and use of our website, mobile-friendly web app, public API, and our official chat-platform integrations such as the Discord and Slack bots (together, the “Service”). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the higher minimum age required by your local law) to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.2. Your Account
You are responsible for the information you provide, for keeping your sign-in credentials confidential, and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. We may suspend or terminate accounts for any violation of these Terms or for conduct that risks harm to other users or the Service.3. Acceptable Use
You agree not to:• use the Service for any illegal, harmful, fraudulent, or infringing purpose;
• harass, threaten, defame, dox, impersonate, or harm others;
• upload, post, or distribute content that is unlawful, obscene, hateful, sexually explicit involving minors, or that violates the rights of any third party;
• interfere with, probe, scan, or test the vulnerability of the Service, or attempt to bypass authentication, rate limits, voting limits, or other security or usage controls;
• reverse engineer, decompile, scrape, or use automated means to extract data from the Service except through endpoints we have made available for that purpose;
• use the Service to send spam, malware, or unsolicited communications;
• resell, sublicense, or otherwise commercialize the Service or access to it without our prior written consent;
• ballot-stuff, manipulate poll outcomes, or vote on behalf of someone else without their consent; or
• use the Service in a way that violates the terms of any third-party platform on which it runs (for example, Discord’s or Slack’s developer terms).
4. User Content
You retain ownership of the polls, descriptions, comments, votes, and other content you submit (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for technical purposes such as resizing or formatting), display, perform, and distribute that content solely for the purpose of operating, providing, improving, and promoting the Service. You represent and warrant that you have all rights necessary to grant this license and that your User Content does not violate these Terms or any third-party rights.Polls are public by default and may be discoverable by anyone with the link. Do not post anything you would not want a stranger to see.
We may, but are not obligated to, review, remove, or disable User Content that we believe violates these Terms or is otherwise objectionable, without notice.
5. Pro Subscriptions and Billing
We offer optional paid subscriptions (the “Pro plan”). Payments are processed by Stripe. By subscribing, you authorize us and Stripe to charge your payment method the applicable fees and any taxes on a recurring basis (monthly or annual, depending on the plan you select) until you cancel. Prices and features may change; we will give you reasonable notice of changes that affect your renewal price.Cancellation. You can cancel your subscription at any time from your account settings or via the Stripe customer portal. Cancellation stops future renewals; your Pro access continues until the end of the current billing period.
Refunds. Except where required by applicable law, subscription fees are non-refundable, including for partially used periods, downgrades, or unused features. We may, at our sole discretion, offer a refund or credit in exceptional circumstances.
Failed payments. If a payment fails, we may downgrade your account to the free plan and limit access to Pro features until the payment is resolved.
6. Free Plan and Usage Limits
The free plan is subject to usage limits, including a monthly cap on the number of polls you can create and the number of movie options per poll. We may change these limits, the features included in each plan, or introduce new limits at any time, with reasonable notice for adverse changes.7. Chat-Platform Integrations
We provide official integrations for chat platforms such as Discord and Slack. When you install an integration:• you represent that you have authority to install the bot in that workspace or server and to grant the permissions it requests;
• you agree to comply with the chat platform’s own terms of service in addition to these Terms;
• you understand that polls posted by the bot are visible to anyone with access to the channel where they are posted; and
• you can uninstall the integration at any time from the chat platform’s settings; doing so revokes our access going forward.
We are not responsible for the behavior, availability, or content of third-party chat platforms.
8. Public API and Developer Tokens
If we make a public API available, you may access it only through the documented endpoints and only using API tokens issued to your account. You are responsible for keeping your API tokens secret and for all activity performed with them. We may impose rate limits, revoke tokens, or restrict API access at any time, including for excessive use, abuse, or violation of these Terms.9. Third-Party Services and Content
The Service relies on and links to third-party services and content, including Firebase, Stripe, Resend, Discord, Slack, TMDB, OMDB, embedded trailers, and AI providers. Movie metadata, poster imagery, and trailers are provided by third parties and remain subject to their own terms and rights; we do not claim ownership of them and make no warranty about their accuracy or availability. You agree to comply with all applicable third-party terms when using features that integrate with them.10. AI Features
Certain features use AI to suggest movies, generate vibe descriptions, or curate poll metadata. AI output is generated automatically and may be inaccurate, incomplete, or unsuitable for your purpose. You are responsible for reviewing AI output before relying on or publishing it. We make no warranty as to the accuracy, suitability, or originality of AI-generated content.11. Intellectual Property
The Service, including its software, design, branding, text, graphics, and the “Movie Night Polls” name and logo, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal or internal organizational use. All rights not expressly granted are reserved. You may not use our name, logo, or trademarks without our prior written permission.12. Feedback
If you send us suggestions, ideas, or feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose without compensation or attribution. We are under no obligation to act on or keep confidential any feedback you provide.13. Beta and Experimental Features
We may from time to time offer features labeled as “beta,” “preview,” or similar. These features are provided as-is, may be unstable, may change or be removed without notice, and are not subject to any service-level commitment.14. No Uptime or Availability Guarantees
The Service is provided on an “as-is” and “as-available” basis. We do not guarantee that the Service will be uninterrupted, error-free, secure, or that any particular content or feature will be available at any given time.15. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the exclusions above apply to you only to the extent permitted by law.16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MOVIE NIGHT POLLS OR ITS OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, AND (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100). Some jurisdictions do not allow the limitation or exclusion of certain damages; in those jurisdictions, the limitations above apply to you only to the extent permitted by law.
